By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Description of Service

Sentic is an AI-powered conversational survey platform that enables users to:

• •Analyze responses using our proprietary Quality Engine to filter and score data quality

Account Registration and Eligibility

Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

Account Creation

To access certain features, you must create an account. You agree to:

• •Maintain and promptly update your account information

Survey Creator Responsibilities

As a survey creator using Sentic, you are responsible for:

• •Obtaining all necessary consents from survey participants before collecting their information
• •Complying with all applicable privacy laws and regulations (GDPR, CCPA, etc.)
• •Providing appropriate privacy notices to your survey participants
• •Using collected data only for the purposes disclosed to participants
• •Ensuring your survey content does not violate any laws or infringe on third-party rights

You acknowledge that you are the data controller for participant data you collect, and Sentic acts as a data processor providing the platform infrastructure.

Subscription Plans and Billing

Plans and Pricing

Sentic offers various subscription plans with different features and usage limits. Current pricing and plan details are available on our website and may be changed with reasonable notice.

Payment Terms

• •Subscription fees are billed in advance on a monthly or annual basis
• •Payment is due immediately upon subscription or renewal
• •You authorize us to charge your designated payment method for all fees
• •All fees are non-refundable unless otherwise specified or required by law

Cancellation

You may cancel your subscription at any time. Cancellation will be effective at the end of the current billing period. You will continue to have access to paid features until the end of that period.

Intellectual Property Rights

Sentic's Rights

The Service, including its software, features, functionality, and content (excluding user content), is owned by Sentic and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express permission.

Your Content

You retain all rights to the content you create using the Service, including:

• •Survey responses collected from your participants
• •Analysis results and insights derived from your surveys

You grant us a limited license to use, store, and process your content solely to provide the Service to you.

AI and Quality Scoring Disclaimer

Sentic uses artificial intelligence and machine learning to conduct conversational surveys and evaluate response quality. While we strive for accuracy:

• •AI-generated questions and quality scores are automated assessments that may not always be perfect
• •You are responsible for reviewing and validating insights before making business decisions
• •Quality scores are indicators, not guarantees of response value
• •We continuously improve our algorithms but cannot guarantee specific outcomes

Disclaimers and Limitations of Liability

Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENTIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• •Unauthorized access to or alteration of your data
• •Errors, inaccuracies, or omissions in any AI-generated content or quality scores
• •Any conduct or content of third parties using the Service

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Sentic and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your survey content or data collection practices.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if:

Upon termination, your right to use the Service will immediately cease. We may delete your account and data, though we may retain certain information as required by law or for legitimate business purposes.
